Business Owners Duty to Invite

Every day, customers are injured while visiting a business — a store, office, restaurant, theater, casino, sports facility or other commercial setting. The accidents vary, but include falls, spills, trips, being struck by falling objects or being exposed to a toxic substance. Sometimes people are even assaulted due to a lack of security, or are accidentally locked inside buildings after hours. Other times, a store unlawfully detains a person in a backroom.

When this kind of injury or event occurs to you or someone you love, a primary concern will be paying all the costs the injury will impose, or receiving compensation for the harm you suffered. You need a firm that fully understands Pennsylvania law and the duty imposed to business owners to you, a “business invitee.”

The Meaning Of The Law

THE STANDARD OF CARE A POSSESSOR OF LAND OWES TO ONE WHO ENTERS UPON THE LAND DEPENDS UPON WHETHER THE LATTER IS A TRESPASSER, LICENSEE OR INVITEE. A BUSINESS INVITEE IS A PERSON WHO IS INVITED TO ENTER OR REMAIN ON THE LAND OF ANOTHER FOR A PURPOSE DIRECTLY OR INDIRECTLY CONNECTED WITH BUSINESS DEALINGS WITH THE POSSESSOR OF THE LAND. ONE WHO BY LOCAL CUSTOM OR A PERSISTENT COURSE OF CONDUCT REASONABLY BELIEVES THAT HIS OR HER PRESENCE IS DESIRED OR PERMITTED FOR THE PURPOSE OF DOING BUSINESS IS ALSO CONSIDERED A BUSINESS INVITEE.

THE DUTY OWED TO A BUSINESS INVITEE IS THE HIGHEST DUTY OWED TO ANY ENTRANT UPON LAND. THE LANDOWNER IS UNDER AN AFFIRMATIVE DUTY TO PROTECT A BUSINESS INVITEE, LIKE YOU, NOT ONLY AGAINST KNOWN DANGERS BUT ALSO AGAINST THOSE THAT MIGHT BE DISCOVERED WITH REASONABLE CARE.
