Jul 10, 2013 - Pedestrian Accidents

Driving at night can be dangerous. Because it is more difficult for drivers to see hazards up ahead, especially pedestrians walking near roads or crossing the street, a tragic pedestrian accident can often result if a driver is not exercising adequate caution. Unfortunately, a collision between a vehicle and a pedestrian – particularly if the driver is speeding – will frequently be fatal to the pedestrian.

Emergency crews in Pennsylvania recently responded to one recent accident involving an SUV and a pedestrian. Reports indicated that two 16-year-old boys were driving on West Union Street when they struck the pedestrian, crashed into a parked car and ended up in an empty lot. The crash occurred around 2 a.m. The pedestrian that was killed in the wreck was a 59-year-old man from Nanticoke.

The fatal accident is still under investigation, although neighbors have expressed concerns about speeding on that particular stretch of road. Some have even taken to erecting homemade signs urging drivers to slow down on the recently repaved road. Authorities are still questioning the driver and passenger and have not determined if the driver will be charged.

In addition to potential criminal liability, any driver in a scenario like this could face civil liability. The loved ones of a deceased pedestrian could file a wrongful death suit seeking compensation for expenses such as funeral bills, lost wages, damages and pain and suffering.

Drivers must watch their speeds and be cautious when driving at night in order to protect the safety of those with whom they share the roads. When a driver’s negligence leads to a tragedy, however, victims and their families have rights and may wish to discuss them further with a legal professional.
