TWO ARRESTED FOR FATAL PEDESTRIAN ACCIDENT IN PENNSYLVANIA
Jul 23, 2013 - Wrongful Death
Residents of Pennsylvania are aware that pedestrians not only utilize walkways near the road, but some rely on them to get to their destinations. Some sidewalks are near busy roadways, which requires pedestrians and cyclists to cross high traffic areas at crosswalks. Dangers and risks are often associated when a person crosses a road. If a driver fails to see the pedestrian or if they are traveling at a high speed, a pedestrian accident could occur.
Two men have been arrested and charged following a fatal pedestrian accident. The accident occurred when a mother and her sons were crossing a busy 12-lane road where a grassy median divided a section of the roadway. Although there were no traffic lights or a crosswalk at this point, the mother and her four young sons crossed the Roosevelt Boulevard. This area is frequented by pedestrians, but also has a reputation for being very dangerous and the source of numerous fatal accidents.
While crossing the roadway, all of them were struck by a vehicle. The mother and three of her sons were killed in the collision, while the woman’s oldest son, who is five-years-old, survived the accident with bumps and bruises. The two men arrested in connection with the fatal accident were presumed to be drag racing. Investigation of the accident is ongoing.
In addition to facing criminal charges, the men presumed to be at fault could face civil liabilities. The loved ones of the deceased and injured could file a wrongful death suit and personal injury claim. This could help cover any medical expenses, funeral costs, lost wages and pain and suffering.
A tragic accident could result due to driver negligence. This could be related to distracted driving, speeding or dangerous behaviors on the roadway. A person injured by a negligent driver should understand their rights. Moreover, the family members of a person killed by a negligent driver could seek compensation to cover any financial burdens that resulted from the accident.
